Procesan a policía por muerte de mexicano

Nueva York — Un policía embriagado que atropelló mortalmente a un mexicano, fue procesado ayer en la corte criminal de Manhattan.

Brandon Colón, de 30 años, enfrenta cargos de homicidio negligente en segundo grado, homicidio vehicular, abandonar la escena del accidente y conducir bajo la influencia de alcohol; por la muerte de Julio Alberto Ortega Moncada.

El juez Shawndya Simpson le impuso a Colón una fianza de 15,000 y ordenó que el acusado regresara a corte el próximo viernes 31 de marzo.

De ser encontrado culpable de los cargos, Colón enfrenta una sentencia de hasta 15 años en la cárcel.

Ortega Moncada, originario de Guanajuato, México, era conocido entre sus amistades como “Zapatón”. Además por su creatividad para crear, según Everardo Reyes.

“Es una noticia bastante desagradable… me enteré por el noticiero”, dijo Reyes, amigo y compañero de trabajo en conciertos y exposiciones artísticas. “Era alguien con quien se podía contar en las buenas y en las malas”.

Al enterarse de la fianza puesta al policía que mató a su amigo, Reyes se limitó a decir que era “muy baja”, pero no quiso extender su opinión respecto al tema. El carismático artista dejó huérfano de 7 años, quien ayer todavía no sabía lo que le había pasado a su padre. “Mi hijo todavía no sabe y necesito tiempo para descansar y para dedicarme a mi hijo”, dijo Leticia, esposa de la víctima. “He sido acosada desde ayer y no quiero dar entrevistas por el momento, tal vez más adelante”, se limitó a decir vía telefónica a EL DIARIO/LA PRENSA.

El fatal accidente ocurrió el martes alrededor de las 3:30 a.m., en el puente que conecta a Manhattan con Queens. Ortega Moncada regresaba a casa de su trabajo como preparador de tragos en un restaurante de Manhattan, cuando decidió detenerse a tomar fotos de dos columnas de donde salía humo, según el amigo de 5 años, Reyes. “Eso fue lo que me contó el amigo con quien estaba y que presenció el accidente, pero él no quiere dar su nombre por cuestión legal”. Según los documentos de la corte, la entrada de la parte baja del puente estaba bloqueada con conos que prohibían el paso a autos o personas, pero tanto Ortega Moncada y su amigo como Colón hicieron caso omiso y entraron. El SUV negro pasó a alta velocidad sin detenerse después de atropellar a su víctima.

Al ser arrestado después que trató de escapar, Colón, quien llevaba 5 años y medio trabajando como policía de viviendas, tenía un nivel de alcohol .139 en su sangre.

NYPD officer charged with DWI in pedestrian fatality

An off-duty New York City police officer was arrested and charged with driving while intoxicated on a closed roadway of the Queensboro Bridge Tuesday after striking and killing a pedestrian taking pictures on the span, officials said.

Brandon Colon, a six-year veteran assigned to a housing development unit on 123rd Street in Manhattan, was driving alone at about 3:15 a.m. on the bridge's deserted outer lane, police said.

The pedestrian, Julio Ortega, 31, of 34-03 38th St. in Astoria, was walking with a friend several hundred feet into the south-facing, one-lane road, police said.


He was pronounced dead on the scene. It was not clear if the other pedestrian was hurt or if he remained on the scene. Colon, 30, had finished a 4 p.m. to midnight shift and may have been headed to his Jamaica home, police sources said.

He was not seriously injured.

The officer refused a Breathalyzer test, and was charged with driving while intoxicated and immediately suspended without pay from the department, police said. The internal affairs office is investigating the incident.

Because the roadway was closed to both pedestrians and cars because of drainage repair work, Colon would have had to swerve around orange traffic cones to access it, officials said.

Son of bridge death victim asks for Papi

The young son of an artist struck and killed on the Queensboro Bridge last week by an allegedly drunken off-duty cop keeps asking why his father won't come home.

"Mami, how come my Papi won't be here anymore?" 6-year-old Akbal Ortega has repeatedly asked his mother in the week since his dad died.

"He's very sad," said the boy's mother, Leticia Valle, 35. "He knows what happened."

Julio Alberto Ortega-Moncada, 31, was standing on the bridge's closed outer roadway early on March 28 when he was hit by housing cop Brandon Colon's SUV, officials said. "[Colon] should have known the limits," Valle said. "That's why he is a police officer."

Ortega-Moncada had stopped on the way home from his job at a Manhattan restaurant to snap pictures of Queens rooftops and the city skyline. "Taking pictures was one of his passions," Valle said.

Colon had allegedly gone out drinking after wrapping up his shift at midnight. He is accused of somehow driving onto the closed roadway, plowing into Ortega-Moncada and just missing his friend Justin O'Grady.

According to court papers, Colon had a blood-alcohol level nearly twice the legal limit when he struck Ortega-Moncada. The cop, who is suspended, and the city are named in a $20 million lawsuit notice filed by Valle.

"In the end, it's never going to compensate her," said her attorney, David Dean of Sullivan Papain Block McGrath & Cannavo. "It's not enough for the loss of a father to a 6-year-old or the loss of a soul mate."

Ortega-Moncada and Valle would have celebrated their 12th anniversary together today.

"He was always my love," Valle said. "We were always united, we shared all our dreams together. ...

"Now it's just the two of us," she said.

Policía ebrio arrolla a joven mexicano

Nueva York -- La vida de un joven artista mexicano fue segada por la presunta imprudencia de un policía fuera de servicio, quien la madrugada del martes, bajo los efectos del alcohol, decidió manejar por un área cerrada del puente de la calle 59 donde se encontraba Julio Alberto Ortega-Moncada tomando fotografías de los rascacielos de Manhattan.

"El regresaba de su trabajo de 'bartender' con un amigo, y al ver los tubos que echan humo en el puente pensó que era una buena oportunidad para hacer fotos", comentó Everardo Reyes, amigo de la víctima, de quien dijo siempre cargaba su cámara con él porque era un amante de la cultura de Nueva York.

Las autoridades indicaron que el agente Brandon Colon, con más de cinco años de experiencia, pasó unas barreras que prohibían el paso en esa zona del puente y atropelló a Ortega-Moncada, de 31 años y conocido por sus amigos como "Zapatón". Después de golpear a su víctima, según cuenta un amigo que se encontraba con el hispano, el policía siguió manejando su vehículo. Una prueba de alcohol arrojó que el agente Brandon tenía .139 de alcohol en su cuerpo, siendo el límite 0.08.

Ortega-Moncada, quien residía en Astoria junto a su esposa Leticia y a su hijo de 7 años, falleció en el acto. Sus amigos no salen del asombro al enterarse de la muerte del joven hispano, descrito como "muy orgulloso de su cultura y sus raíces mexicanas".

"Era un excelente inquilino, que siempre me hacía muchos favores", señaló Electera Grisafi, dueña del apartamento donde vivía Ortega-Moncada.

Colón fue acusado formalmente ayer de negligencia en segundo grado, negligencia vehicular, abandonar la escena de un accidente y operar un vehículo bajo los efectos del alcohol. El juez le impuso una fianza de quince mil dólares.

El cuerpo de Ortega-Monacada será velado mañana en la Funeraria Ortiz, en Manhattan. Sus restos serán trasladados a México el sábado.

Wife of man killed on 59th Street bridge speaks out

(New York-WABC, April 4, 2006) - For the first time we are hearing from the wife of a man who was killed on the 59th Street Bridge.

Julio Ortega was the victim of an alleged drunk driver -- a driver who was an off-duty New York City police officer.

In an exclusive interview, his wife says not only is the officer to blame but so is the city.

Eyewitness News reporter Joe Torres has the story.

'A man with a big heart' said Leticia Valle of her common-law husband Julio Ortega. Three days after Ortega died on the 59th Street Bridge and Valle filed a $20 million civil lawsuit against the alleged drunk driver who killed him.

Investigators charged Brandon Colon, an off-duty police officer, with DWI, vehicular homicide and leaving the scene of an accident.

Valle: "It's not a question of who is to blame ... but when people commit something - involuntarily or voluntarily, there's a price one has to pay."

In the early morning hours of March 28th, Julio Ortega was walking home across the 59th Street Bridge. He stopped for a moment to capture some photos of the city skyline at dawn. Investigators say Colon drove onto a closed-off section of the bridge. His SUV struck and killed Ortega. The family's lawsuit contends the city is also responsible for what happened.

David Dean, attorney: "We are exploring the culpability of the city for placing barricades in a manner that didn't prevent this accident."

Ortega was taking the early morning pictures for an upcoming exhibition featuring the work of Mexican photographers who live in New York. In one photo, Ortega is with his wife, their 6-year-old son Akbal and Mayor Bloomberg who honored Ortega last year as part of the city's Cinco de Mayo celebrations.

Emily Socolov is head of a Mexican cultural organization called 'Mano a Mano'.

Socolov: "I think that he wanted to convey the vitality of the life of the Mexican community and also the poignancy of situations."

Meantime, city attorneys told us they have not yet received the legal documents involved the in the Ortega family civil suit, but added they will thoroughly evaluate the paperwork.

(New York - WABC, March 28, 2006) - A New York City cop is charged tonight with driving drunk and killing a man.

Investigators say he was off-duty when he drove down a blocked lane on the 59th Street Bridge and ran down a man taking pictures.

Eyewitness News reporter Marcus Solis has the story from the scene.

Friends of the victim were too upset to speak on camera, but they describe Julio Ortega as a gifted photographer. It was Ortega's passion for the art form that led him to the Queensboro Bridge early this morning. The 31-year-old was taking pictures of steam rising above the city skyline when he was hit by a car and killed.

Police say that car was being driven by an off-duty cop who was drunk. Brandon Colon who has been on the force for five years is now under arrest.

Police say the officer was in the Queens bound outer roadway when the accident occurred. The lane was closed for construction, and it's unclear how Colon got past barriers that had been set up to close off the entrance.

Ortega was killed instantly by the force of the crash. A friend he was with escaped by diving out of the way and called 911. This afternoon, detectives returned to the Manhattan side of the bridge looking for video from a nearby surveillance camera.

Meantime in Long Island City, friends are mourning the loss of an artist active in the Mexican community who leaves behind a wife and young son.

Officer Colon is assigned to the housing bureau in Harlem. Sources say he registered .13 on the breathalyzer that was administered at the scene. He refused to take a second breathalyzer. Charges against him are pending, but he has been suspended from the force.

NYPD officer sued for fatal DWI crash

(New York-WABC, April 1, 2006) - A New York City Police officer, accused of killing a man while driving drunk, is now facing a lawsuit on top of criminal charges.

The family of Julio Ortega is now suing Officer Brandon Colon and the City of New York.

Investigators say Colon was off-duty earlier this week, when he struck and killed Ortega while driving on the Queensboro Bridge. Mr. Ortega was walking on the bridge taking pictures.

Officer Colon has been suspended. He's facing charges for DWI, vehicular manslaughter, and leaving the scene of an accident.
